Terms of Service

Welcome to AndBe. By creating an account or using the AndBe application ("App"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Description of Service

AndBe is an AI-powered language learning platform that provides conversational practice with AI teachers. The service includes lesson content, speech-to-text and text-to-speech functionality, achievement tracking, and in-app purchases for lesson credits.

2. Account Registration

To use AndBe, you must create an account using either Sign in with Apple or email registration. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information during registration.

3. Credits and Subscriptions

AndBe uses a credit-based system. Each lesson requires one credit to start. Credits come in two forms:

• Purchased credits are bought through Apple's In-App Purchase system. These do not expire, have no cash value, and cannot be transferred.
• Subscription credits are allotted monthly to Premium subscribers (including Founding Members — see Section 4). Subscription credits are use-it-or-lose-it: any unused subscription credits are cleared at each monthly renewal and replaced by the next month's allotment. Purchased credits in your wallet are never affected by subscription resets.

No refunds or cash replacements. All credits — purchased or subscription, of any type — are final and non-refundable. We do not provide refunds, cash, or equivalent replacements for any credits under any circumstances, including but not limited to: unused purchased credits, expired subscription credits, credits remaining after voluntary account deletion, credits held during service outages, or credits associated with a suspended or terminated account. This applies equally to all users, including Founding Members and paying Premium subscribers. The only exceptions are refunds required by applicable consumer-protection law or refunds processed by Apple through the App Store's in-app-purchase refund policies. Refund requests related to Apple purchases should be directed to Apple through the App Store.

Apple-issued refunds. If Apple grants you a refund for a subscription or in-app purchase, Apple will return the payment to your original method of payment. Any subscription or purchased credits previously awarded to your account in connection with that purchase will not be automatically reversed: your subscription will be marked inactive and will not renew, but credits already in your wallet remain available for use until consumed. This applies whether the Apple refund is processed during or after the subscription period.

Subscription credit reset schedule. Subscription credits are issued and cleared on a calendar-month basis. The first day of each calendar month (or the next processing window thereafter), any unused subscription credits from the prior month are cleared and a fresh allotment is granted to active subscribers. This means a subscription started mid-month will see its first credit reset on the first day of the following calendar month, not on the subscription anniversary.

4. Founding Member Program

The Founding Member Program grants a limited number of users free ongoing access to Premium-tier features, subject to the terms below.

• Spots: 1,000 Founding Member spots are available per language market (for example, English-to-Spanish). Additional spots open only when new language markets launch. Due to concurrent-award tolerance, the actual award count per market may exceed 1,000 by a small margin.
• Qualification: You must complete at least 10 successful lessons (lesson score of 7/10 or higher) in a given language market before that market's spots are exhausted. Lessons scoring below 7/10 do not count toward qualification; you may complete additional lessons to reach 10 successful ones.
• Benefit: On qualification you receive 90 subscription credits (equal to 90 lessons) immediately, plus a recurring monthly allotment of 90 subscription credits, at no cost.
• Permanence of status: Your Founding Member badge and status are permanent and are not revoked if you become inactive. Status can be removed only at your request (for example, via account deletion) or as otherwise required by law.
• First-month grace: The first monthly renewal after qualification grants 90 subscription credits regardless of activity. This ensures that users who qualify late in a calendar month still receive a full month of Premium access.
• Monthly activity requirement: From the second monthly renewal onward, the 90-credit allotment is contingent on completing at least 10 successful lessons in the prior calendar month. Months that fall short receive no allotment. Your Founding Member status and badge remain unaffected; allotments resume automatically on any subsequent qualifying month.
• Per-market tracking: Qualification is tracked per language market. Founding Member status in one market does not transfer to another.
• Non-transferable: Founding Member status is tied to your account and cannot be sold, transferred, or gifted. It is not exchangeable for cash or other credits.
• Program modifications: While we intend the Founding Member benefit to continue on the terms above, we reserve the right to modify Premium-tier benefits (including the monthly credit allotment) at any time. Any material changes will apply equally to Founding Members and paying Premium subscribers, and we will provide reasonable notice as described in Section 12.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to access the App (bots, scrapers, etc.)
• Interfere with or disrupt the App's functionality
• Use the AI teachers to generate harmful, abusive, or inappropriate content
• Reverse-engineer, decompile, or disassemble the App

6. AI-Generated Content

AndBe uses artificial intelligence to generate lesson content, conversation responses, and learning feedback. While we strive for accuracy, AI-generated content may occasionally contain errors. AndBe is a practice tool and should not be relied upon as the sole source of language instruction. We do not guarantee the accuracy of AI-generated translations, grammar corrections, or cultural guidance.

7. Intellectual Property

The AndBe App, including its design, code, AI models, and content, is owned by AndBe and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App. Content you create during lessons (your messages and responses) remains yours.

8. Privacy

Your use of AndBe is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Disclaimer of Warranties

AndBe is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding specific learning outcomes.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AndBe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Account Termination

You may delete your account at any time through the App's settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. Unused credits will not be refunded upon voluntary account deletion.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of AndBe after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the App.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes arising from these Terms or your use of AndBe will be resolved in the courts of Delaware, United States.
